The lawsuit lists a pickup driver Michael Lippmann and Carson Oil Co. as defendants. It claims that the pickup was speeding in heavy rains on Interstate 5 and that just before the accident, it had passed a truck belonging to Carson Oil Co. that sprayed water onto it. According to the plaintiff, the sprayed water, along with the standing rain water, caused the pickup to lose control, cross the grassy median and crash into Fritz’s Nissan Sentra that was travelling southbound.
Fritz, 54, was killed at the spot while his passenger Cary Fairchild, 64, succumbed to his injuries 10 days later.
The lawsuit seeks $9.5 million as a compensation.
